Eudora police arrested a 24-year-old man Sunday evening after his 4-year-old daughter suffered a broken arm.

Police Chief Grady Walker said the incident, which had occurred in the past 72 hours, was still under investigation. Officers believed the incident occurred in Eudora.

Douglas County prosecutors Monday afternoon filed an aggravated battery charge in the case against Max A. Alcanter.

Defense attorney James Rumsey, who represented Alcanter at a bond hearing Monday afternoon said Alcanter had no prior criminal history and that there was “evidence that there was some kine of discipline that was attempting to be given” to the child.

Pro-tem Judge James George agreed to let Alcanter sign his own $10,000 bond instead of having to use a bondsman.

According to jail records, a Eudora officer arrested Alcanter in Kansas City, Mo. Rumsey said Alcanter had arranged to live with family in Kansas City, Kan., while the case was pending because he was prohibited from having contact with the child or returning to the residence where the alleged incident occurred in the 900 block of Oak Street.

His next court appearance is scheduled for 2 p.m. May 1.
